New pre-foreclosure filings from published notices of action, every day

Terms of Service

Effective October 29, 2026

These terms govern your use of PreforeclosureSearch at www.preforeclosuresearch.com (“the service”, “we”, “us”). By using the site or creating an account, you agree to them. If you do not agree, do not use the service. How we handle personal information is covered separately in our Privacy Policy.

What the service is

PreforeclosureSearch reads published notices of foreclosure suits, keeps structured fields from them (such as the court and case number, the lender, the date first published, the owners and parties named, the property and the plaintiff’s attorney), folds every printing of one case into one record, and makes them searchable. Every case is a suit in progress: a record is not a statement that a property will be sold or that its owner owes what the plaintiff claims. The methodology describes how that is done and what it misses.

We are not a government agency, a court, a clerk of court, a real-estate brokerage, or a law firm, and we are not affiliated with any court, lender, party or attorney named in a record.

The data has limits

Each record reflects the published notices as we read them. A notice may leave fields out, a later court filing may change who is handling a case, and some cases never publish a notice at all. Reading a notice can also go wrong or be incomplete. So:

  • the service is for research and lead generation, and it is not an authoritative record of any case, debt, deadline or title;
  • confirm a case’s file, its owner and any deadline with the clerk of court or the plaintiff’s attorney before you act on it;
  • nothing on the site is legal, financial, tax or investment advice, and a response date shown here is not a legal determination of anyone’s rights.

If a record disagrees with its published notice, tell us at support@preforeclosuresearch.com and we will check it.

Accounts

  • You can sign in with Google or with a one-time link sent to your email address. You must give an email address you control.
  • You must be at least 18 and able to form a binding contract to create an account.
  • An account is for one person. Do not share your sign-in or let others use your account.
  • You are responsible for activity on your account. Tell us promptly at support@preforeclosuresearch.com if you think someone else has used it.

Paid plans

The full record, saved searches, alerts and export come with a paid plan: Starter ($29 a month), Pro ($49) or Business ($99), as described on the pricing page. Without a plan, you can see how many cases each page and each search covers, and the lender, city, case number and date first published of the newest five cases on each page’s list. Every other case, and the owners, addresses and attorney on every case, open with a plan. What you can see without a plan is described on the pricing page and may change. Starter opens full records and alerts in one state you choose, which can be changed once every 30 days; Pro and Business cover every state and county we cover. CSV export comes with Pro and Business.

  • Who you pay: payments are processed by Creem, which acts as merchant of record and is the seller of the subscription for payment, tax and invoicing purposes. Any sales tax or VAT due is added at checkout. Creem’s own terms apply to the payment.
  • Free trial: every plan starts with a 3-day free trial. A card is taken at checkout and nothing is charged during the trial. Everything in the plan is open during the trial except CSV export, which opens with the first payment. Unless you cancel before it ends, the first monthly payment is taken when it ends. You can also end the trial early, up to a day before it ends, with the “Start <your plan> now” button under Subscription on your account page: the first payment is then taken at checkout, the plan runs and renews from that day, and the trial is cancelled once the payment is confirmed, so it is never charged as well. One trial per account; an account that has subscribed before starts paying straight away.
  • Renewal: plans are billed monthly and renew automatically until you cancel. Cancel any time from your account page. Cancelling stops the next payment, and your plan stays open until the end of the period you have paid for.
  • Changing plans: moving to a higher plan takes effect at once and the difference for the rest of the period is charged then; moving to a lower plan refunds the unused part. During a trial a change costs nothing until the trial ends.
  • Failed payments: if a payment fails, the card is retried. Records stay readable meanwhile, but alerts and CSV export pause until the payment goes through, and the plan ends if it never does.
  • Refunds: if the service does not work for you, email support@preforeclosuresearch.com within 7 days of a payment and we will refund that payment; the plan ends when it is refunded. Otherwise, payments for a period that has started are not refundable, except where the law requires it.
  • Changes to prices: we will email you at least 30 days before a price change applies to your plan, and never change the price of a period you have already paid for.

Acceptable use

You may use the service and the data you get from it for your own business. You agree not to:

  • resell, sublicense, republish or redistribute the data in bulk, or use it to build or feed a competing database or service offered to others;
  • scrape, crawl or download the site by automated means beyond what our robots.txt allows, or get around plan limits, rate limits or access controls, including by using several accounts;
  • use the data to decide anyone’s eligibility for credit, insurance, employment or housing. PreforeclosureSearch is not a consumer reporting agency, and the data is not a consumer report under the Fair Credit Reporting Act;
  • use the data to harass, threaten, stalk, pressure or defraud anyone, including owners, heirs, tenants and anyone else named in a record;
  • contact anyone in breach of the laws that apply to you, including state laws on dealing with homeowners in foreclosure (such as foreclosure-rescue and equity-purchase rules), the rules on direct mail and real-estate solicitation where you work, the Telephone Consumer Protection Act and do-not-call rules for calls and texts, and the CAN-SPAM Act for email;
  • interfere with the service, probe it for vulnerabilities without our permission, or break any law in using it.

Ownership

The underlying foreclosure notices are public records. The site itself — its software, design, and the way we compile, structure and verify the data — belongs to PreforeclosureSearch. These terms give you a limited, non-exclusive, non-transferable right to use the service as they describe. Anything you save, such as searches and alerts, stays yours.

Emails

By creating an account you agree to receive the service emails needed to run it, such as sign-in links. Alert emails are sent only for alerts you turn on, and each one has an unsubscribe link.

Suspension and closing an account

You can close your account at any time by emailing support@preforeclosuresearch.com. We may suspend or close an account that breaks these terms, and we will tell you why unless the law or a safety concern prevents it. If we close an account without cause, we will refund the unused part of any period you have paid for.

Disclaimers

The service and all data are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be uninterrupted, error-free, or complete for any county or state.

Limitation of liability

To the fullest extent the law allows, PreforeclosureSearch will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities or losses from a purchase, offer, contact or decision made in reliance on the data. Our total liability for any claim about the service is limited to the greater of the fees you paid us in the three months before the claim, or US$50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

Indemnity

If your breach of these terms, or your misuse of the data, leads to a claim against us, you agree to cover our reasonable costs and losses from that claim.

Changes to these terms

We may update these terms. The effective date above will change when we do, and if a change materially affects account holders we will email you before it takes effect. Continuing to use the service after that means you accept the new terms.

General

If any part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
